Terms & conditions of sale
Last updated: 26 September 2026
Article 1 — Purpose and scope
These terms and conditions of sale (the "Terms") govern, without restriction or reservation, all sales concluded on the Site between JADOPT UNE PLANTE (the "Seller") and any consumer (the "Customer"). Placing an order implies the prior, express and unreserved acceptance of these Terms, evidenced by a checkbox during the ordering process. The applicable Terms are those in force on the day the order is placed.
Article 2 — Pieces
The Site offers for sale living baobabs (Adansonia digitata) (hereinafter the "Pieces"), available in three sizes (Intime, Signature, Monument). Each specimen is supplied with its pot, a numbered certificate of authenticity, a phytosanitary certificate attesting its official plant-health inspection and a care guide. As each specimen is a living, one-of-a-kind piece, natural variations in silhouette, branching and dimensions (given for guidance, within ± 10%) may exist compared with the photographs shown, without this constituting a lack of conformity. The essential characteristics of each piece are set out on its page on the Site.
Article 3 — Prices
Prices are shown in euros, inclusive of all taxes (French VAT included at the applicable rate). Tracked and insured delivery, hand-delivered, is charged at €45 including VAT; this amount is shown to the Customer before the final confirmation of the order. The Seller reserves the right to change its prices at any time; pieces are invoiced on the basis of the prices in force at the time the order is recorded.
Article 4 — Ordering
The ordering process comprises the following steps: selecting the specimen size and adding it to the cart; reviewing the cart contents; entering contact details and the delivery address; choosing the delivery method; accepting these Terms; secure payment. In accordance with Article 1127-2 of the French Civil Code, the Customer is able to review the details of the order and its total price and to correct any errors before confirming it. The sale is deemed concluded upon confirmation of payment. A confirmation email summarising the order is sent to the Customer. The Seller reserves the right to refuse any order on legitimate grounds, in particular in the event of a prior dispute or where delivery to the address provided is impossible.
Article 5 — Payment
Payment is made online, in a single instalment, by bank card via the secure Stripe Checkout solution. Card details never pass through the Site and are not stored by the Seller. The full price is due at the time of ordering. The order is only processed once payment has been confirmed by Stripe.
Article 6 — Delivery
Deliveries are made exclusively within the twenty-seven Member States of the European Union, excluding territories outside the customs or VAT territory of the Union (in particular the French overseas departments and territories, the Canary Islands, Ceuta, Melilla, the Åland Islands, Heligoland, Büsingen, Livigno, Campione d'Italia and Mount Athos). Any delivery address outside this area is refused when ordering; an order nevertheless placed for such an address is cancelled and refunded in full. As each specimen is prepared to order, delivery takes place within 5 to 15 business days from confirmation of payment, and in any event no later than thirty (30) days, unless otherwise agreed with the Customer. The concierge team contacts the Customer within 24 business hours of the order to arrange a delivery appointment. The risk of loss or damage passes to the Customer when the Customer (or a third party designated by them) takes physical possession of the piece. If a parcel is visibly damaged on delivery, the Customer is invited to note reservations with the carrier and to contact the concierge team without delay, with supporting photographs.
Article 7 — Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the piece to exercise their right of withdrawal, without having to give any reason. The full procedure, the specific conditions arising from the living nature of the piece and the model withdrawal form are set out in the Right of withdrawal section, which forms an integral part of these Terms.
Article 8 — Statutory warranties
Independently of any commercial warranty, the Seller remains bound by the statutory warranty of conformity (Articles L217-3 to L217-14 of the French Consumer Code) and the warranty against hidden defects in the item sold (Articles 1641 to 1649 of the French Civil Code).
Statutory information notice (Article D211-2 of the French Consumer Code — translation)
The consumer has a period of two years from delivery of the goods to obtain the implementation of the statutory warranty of conformity where a lack of conformity appears. During this period, the consumer is only required to establish the existence of the lack of conformity, not the date on which it appeared.
The statutory warranty of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.
If the goods are repaired under the statutory warranty of conformity, the consumer benefits from a six-month extension of the initial warranty.
If the consumer requests repair of the goods but the seller imposes replacement, the statutory warranty of conformity is renewed for a period of two years from the date the goods are replaced.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if: 1° the trader refuses to repair or replace the goods; 2° the repair or replacement takes place more than thirty days later; 3° the repair or replacement causes major inconvenience to the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or bears the installation of the repaired or replacement goods; 4° the non-conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious as to justify an immediate price reduction or termination. In that case, the consumer is not required to request repair or replacement of the goods beforehand.
The consumer is not entitled to have the sale rescinded if the lack of conformity is minor.
Any period during which the goods are immobilised for repair or replacement suspends the remaining warranty period until delivery of the restored goods.
These rights derive from the application of Articles L217-1 to L217-32 of the French Consumer Code.
A seller who obstructs the implementation of the statutory warranty of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L241-5 of the French Consumer Code).
The consumer also benefits from the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.
As the piece is a living organism, the assessment of conformity takes into account the characteristics inherent to plants and the Customer's compliance with the instructions in the care guide provided. Decline resulting solely from a failure of care after delivery does not constitute a lack of conformity.
Article 9 — Aftercare and guidance
Each order includes a personalised care guide and access to concierge follow-up after delivery. The advice provided is by way of guidance; the Customer remains responsible for the care given to the specimen after delivery.
Article 10 — Personal data
The Customer's personal data is processed in accordance with the Privacy policy, which forms an integral part of these Terms.
Article 11 — Consumer mediation
In accordance with Articles L612-1 et seq. of the French Consumer Code, the Customer may refer any dispute with the Seller free of charge to a consumer mediator with a view to an amicable resolution, after first sending a written complaint to customer service. The contact details of the mediator to which the Seller belongs are provided on request at contact@ajjuna.com.
Article 12 — Governing law and disputes
These Terms are governed by French law, and the French version of these Terms prevails over this translation. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the French courts shall have jurisdiction, subject to any mandatory protective provisions applicable to consumers residing in another State.
Article 13 — Customer service
For any question or complaint: by email at contact@ajjuna.com, by phone on +33 1 40 00 00 00, or by post to JADOPT UNE PLANTE, 148 rue de Lourmel, 75015 Paris, France.

2. Data collected
When you use the Site, we collect the following data: identity and contact details (surname, first name, email, phone), delivery address and delivery instructions, order history, password (stored exclusively in hashed form — never in plain text), your communication subscription preference, and technical data strictly necessary for operation (server logs). Bank card data is collected and processed exclusively by Stripe and never passes through our servers.
3. Purposes and legal bases
Your data is processed for: managing orders, payments and deliveries (legal basis: performance of the contract); managing your customer account and concierge follow-up (performance of the contract); complying with our accounting and tax obligations (legal obligation); fraud prevention and Site security (legitimate interest); sending care advice and communications, only if you have consented via the dedicated checkbox (consent, which may be withdrawn at any time).
4. Recipients and processors
Your data is accessible to the authorised staff of JADOPT UNE PLANTE and shared, strictly to the extent necessary, with our service providers: Stripe (secure payment), Brevo (transactional emails), Railway (website hosting), the carrier responsible for delivery, and, for address entry, the French public geocoding service (characters typed into the address field are relayed via our server to provide suggestions) as well as, where applicable, Google Places. Some providers (notably Stripe, Google and Railway) may process data outside the European Union; such transfers are covered by appropriate safeguards (European Commission standard contractual clauses).
5. Retention periods
Account data is kept for as long as the account is in use, then for three (3) years after the last activity. Order and invoice data is kept for ten (10) years in accordance with accounting obligations. Marketing-related data is kept for three (3) years from the last contact, unless consent is withdrawn earlier.
6. Cookies
The Site uses neither advertising cookies nor third-party audience-measurement trackers. A single technical cookie ("baobab_session") is set when you log in to your account, to keep your session secure (HttpOnly, duration: 30 days). A second technical cookie ("baobab_lang") stores your language preference. These cookies, strictly necessary for the service you request, are exempt from consent requirements under the guidelines of the CNIL (the French data protection authority).
7. Security
We implement appropriate technical and organisational measures: encrypted connections (HTTPS), password hashing (bcrypt), payment delegated to a PCI-DSS certified provider, secure sessions and restricted access.
8. Your rights
Under Regulation (EU) 2016/679 (the "GDPR") and the French Data Protection Act, you have the right to access, rectify, erase, restrict and object to the processing of your data, the right to data portability, and the right to set directives regarding your data after your death. You may withdraw your consent to communications at any time (unsubscribe link or the checkbox in your account area). To exercise your rights, contact us at contact@ajjuna.com; a reply will be provided within one month. If you consider that your rights have not been respected, you may lodge a complaint with the CNIL (www.cnil.fr — 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, France) or with the supervisory authority of your country of residence.
Right of withdrawal
Last updated: 26 September 2026
Your right in brief
You have a period of fourteen (14) days from the day on which you (or a third party designated by you, other than the carrier) take physical possession of the piece to withdraw from the contract, without having to give any reason.
How to exercise this right
Before the 14-day period expires, notify us of your decision by an unambiguous statement: by email to contact@ajjuna.com or by post to 148 rue de Lourmel, 75015 Paris, France, using the model form below if you wish. We will send you an acknowledgement of receipt without delay.
Returning the piece
You must return the piece to us without undue delay and no later than fourteen (14) days after informing us of your decision to withdraw. The direct cost of returning the piece is borne by you; as this is a living, fragile piece that cannot be returned by ordinary post, this cost is estimated at €45 including VAT for a return from mainland France, i.e. the cost of specialised transport equivalent to the initial delivery; for a return from another country, an estimate is provided by the concierge team before the return is arranged. The concierge team will assist you in arranging this return so as to protect the specimen (original packaging recommended, root system protection, prompt dispatch).
Specific point arising from the living nature of the piece: in accordance with Article L221-23 of the French Consumer Code, you may be held liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature and characteristics. For a living plant, this means maintaining the basic care described in the care guide (light, watering) between receipt and return. Any decline attributable to a lack of care or to unsuitable return packaging may result in a deduction from the refund.
Refund
We will refund all sums paid, including standard delivery costs (excluding any additional costs arising from your choice of a delivery method more expensive than the standard method offered), without undue delay and no later than fourteen (14) days from the day we are informed of your decision. We may defer the refund until we have recovered the goods or received proof of dispatch. The refund is made using the same payment method as the one used for the order, at no cost to you.
Model withdrawal form
